Powers

The President, among other powers, represents the Court of Audit, convenes and chairs the Plenum and the Management Board, setting the meeting agendas, leading discussions, deciding where votes are tied with his casting vote and agreeing on the implementation of the resolutions adopted. The President provides for the expenses of the Court and the procurement of works, goods, services, supplies and other services necessary for its operation, when authorized by the Plenum or the Management Board or have ordinary and periodic nature.

The President is also in charge of the head management of staff, convenes the call of the selective competitions to fill vacancies in the bodies of the Court of Audit or contract agents, appointments of the Court staff, appoint and remove temporary staff (at the proposal, if any, of the Counsellors) and decide on the administrative status of the Court of Audit civil servants and, where appropriate, the retirement thereof.

The President also has the overriding authority over the audit services of the Court and is responsible for promoting and exercising disciplinary powers in cases of serious misconduct.

The President may delegate the exercise of the powers conferred on him to the Secretary-General to exercise the powers regarding recruiting of staff and as contracting authority, should no prior authorization or knowledge by the Plenum or the management board be required. 

Election and composition

The President of the Court of Audit is appointed by the King from among its members, at the proposal of the Plenum for a three-year period.  The election is held by secret ballot by Audit Counsellors, who meet on his first day of office or, if not possible, on the next business day, or after the end of the three-year period since the previous election or in the event of a vacancy in the position.  After the election, the full Court will be called for the next working day, including the Chief Prosecutor, who shall examine the legality of the election and make the proposal to the President of the Congress for submission to the King.

The Counsellor elected President shall take oath or promise before the King and shall take office before the full Court.  The oldest Counsellor shall act as President until the elected person has taken office.

In cases of absence, illness or any other legal disability of the President, his duties will be assumed in this order, by the Presidents of the Audit and Prosecution Sections and, in their absence, by the oldest Counsellor.
